Terms of Service

These Terms govern your use of Cari, provided by Ember Development Studios, LLC (“we”, “us”, or “Ember”). By creating an account or using the service, you agree to these Terms. You must be at least 18 years old and authorized to bind your business to create an account.
The service
Cari is an AI receptionist that answers your customers, captures leads, and books appointments across web chat, SMS, WhatsApp, Instagram and Facebook Messenger, email, and live phone calls (real-time AI voice), using the business information and knowledge you configure or authorize us to learn. Cari can also take messages, answer FAQs, escalate to a human, send reminders and follow-ups, request reviews, manage a waitlist, send consented outbound follow-ups, reply in 10+ languages, and collect booking deposits and balances through Stripe.
AI-generated responses
Cari’s responses, transcripts, and summaries are generated automatically by AI and may occasionally be incomplete, inaccurate, or out of date. Nothing Cari says is legal, medical, financial, or other professional advice. You are responsible for reviewing bookings, leads, messages, and escalations, and for confirming anything important with your customers directly.
Your responsibilities
- Provide accurate business information, pricing, availability, and knowledge content.
- Obtain all consents required to contact your customers on the channels you enable, and to record or transcribe calls where applicable, and comply with the recording-consent laws of the states and countries where your customers are located.
- Comply with applicable messaging laws and carrier requirements, including the TCPA and A2P 10DLC registration rules, where you enable SMS or WhatsApp.
- Use the service lawfully, only for your own business, and never to send spam, unlawful, deceptive, or harmful content.
- Keep your account credentials secure and notify us promptly of any unauthorized use.
Subscriptions & billing
- Paid plans (Starter, Growth, and Pro) are billed monthly or annually in advance through Stripe.
- New subscriptions start with a 14-day free trial that requires a valid card on file; if you do not cancel before the trial ends, billing begins automatically.
- Each plan includes a monthly bundle of AI voice minutes. Voice usage beyond the included minutes is billed as metered overage at a per-minute rate.
- Booking deposits and payments you collect from your customers are processed through Stripe and are subject to Stripe’s terms; applicable taxes may apply.
- Subscriptions renew automatically until cancelled. You can cancel anytime from the billing portal; access continues through the end of the paid period.
- Fees, including voice overage charges, are non-refundable except where required by law.
- We may change our prices; we will provide prior notice before any change takes effect on your account.
Acceptable use
You may not attempt to disrupt or abuse the service, reverse-engineer or extract its underlying models or source code, or use it to violate the rights of others. We may suspend accounts that do.
Data ownership
You own your business data and your customers’ data collected through Cari. We process that data on your behalf, as described in our Privacy Policy and, where applicable, a Data Processing Addendum. Ember owns the Cari platform, software, and all related intellectual property; these Terms do not transfer any of that to you.
Third-party services
Cari relies on third-party services (including those listed in our Privacy Policy) to deliver messaging, voice, payments, and AI functionality. Your use of features built on those services is also subject to the applicable third party’s terms.
Disclaimers
The service is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee that the AI’s responses, transcripts, or bookings will be error-free, uninterrupted, or handled correctly every time.
Limitation of liability
To the maximum extent permitted by law, Ember Development Studios, LLC is not liable for indirect, incidental, special, or consequential damages, or for lost profits or revenue, arising from your use of the service. Our total liability for any claim is limited to the fees you paid us in the three months before the claim arose.
Indemnification
You agree to indemnify and hold Ember harmless from any claim, loss, or expense (including reasonable attorneys’ fees) arising from your content, your use of the service, your violation of these Terms, or a claim brought by one of your customers, including claims related to messaging consent or call-recording consent.
Suspension & termination
You may stop using the service at any time. We may suspend or terminate accounts that violate these Terms, pose a security risk, or are used unlawfully.
Governing law
These Terms are governed by the laws of the United States and the State in which Ember Development Studios, LLC is organized, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the service will be resolved in that jurisdiction.
Changes to these Terms
We may update these Terms; material changes will be reflected in the “Last updated” date above.
